EcoFin, Inc.’s, Wrongful Death Economist mirrors the format of the Personal Injury Economist but also produces projected earnings capacities of both the decedent and surviving spouse. The combined after-tax earnings are adjusted for the personal consumption patterns of the decedent based upon family income and household members. The pecuniary loss of earnings capacity (Maintenance and Support) is determined by taking the difference between the combined family earnings, after consideration of taxes and personal consumption, and the after-tax earnings of the surviving spouse.
Employment benefits also reflect the appropriate adjustments. For example, health care coverage reflects only the additional cost of covering family members and there is no category for life insurance since such a policy would presumably have paid the benefit.
The loss of household services contains the option of applying a personal consumption factor. Since no studies exist comparing the extent to which personal household services are performed for one’s own benefit or for the communal benefit of the family, the consumption factor, if implemented, is the same as the statistical averages applied to family income.
Like the Life Care Plan Economist and other EcoFin products, the Wrongful Death Economist is designed to be used by the layman with minimal knowledge of the underlying economics. The program is controlled by Visual Basic macros that automatically perform calculations, format exhibits and generate graphs that conform to the specific circumstances of the individual. Details of its use are contained in a user’s manual and illustrated in simple training videos.
